Having now read the transmittal, I see/understand that the patent owners statement of the interview, which was part of the request for extension, was perhaps not defined as the "official" statement. In any case, it gives the patent owner the opportunity to repeat it again. Thus driving home the point that it remains our expectation that a reexam cert is going to be issued. The PTO can not argue that the extension was for the purpose of preparing an appeal. Or at least can not get a away with that argument. (I hope)
