If what the examiner said is no longer valid, shouldn't there should be an official communication pointing that out so the patent owner has sufficient time to formulate the appeal? Until the examiner retracts what was said, there is no reason to spend time on an appeal. Would such a communication not be promptly posted on the IFW?

Can we assume that silence is golden?
