It is likely that you have it backwards. It is TPL/PTSC that do not wish (up to now) to take companies to court. How many have we sued first? I believe the number is ZERO. (corrections welcomed) Now that might change in the future, but based on the history to date, it would appear negotiating outside of court is the preferred route. If your attempting to negotiate and not come across as being too adversarial, then the in-your-face attitude may not apply.
