That is an excellent point. The US patent is easier to pick apart based on the divide and conquer strategy. The parts are not the sum and dividing them diminishes their import.
The German decision was a better determination and easier to enforce. Their system seems to be something that we should follow here in the states - less BS..more get to the point..make a determination..and live with the results albeit good or bad..
I have always thought that we have not pushed the Europe patent harder because we might get a bigger bang for our respective buck..and perhaps the infringers may be less apt to buck the system based on the fact that it appears to be harder to push back via the German courts / system.
