IMHO it is the examiners that both TPL and PTSC are concerned about. It is better to say nothing until 336 and 148 are out of the woods. Don't you think that is prudent?
They're actually starting to say a bit more than "nothing" about the USPTO re-exams - see below. I don't know how any talk re: the USPTO would effect examiners. However, I don't think it actually matters what "they" state about the USPTO re-exams right now as it relates to the SP. It's going to take a lot more than talk for Patriot to get out of this hole.
