The '336 re-exam denial decision wasn't technically due until August 29th or so. Based on the reviews of the processes on the 148, 336, and 584 so far, it seems relatively uncommon for the USPTO to act BEFORE they are required to.
HOPEFULLY, this telegraphs that a decision on the '336 consideration of the response after the final rejection has been made and that we'll see the goal of "Notice of Intent to Issue a Reexam Certificate".
There is still the opportunity for the Sirius application that was incomplete to be resubmitted but it seems that IF the '336 decision has been made, then even if resubmitted, they would be denied on grounds similar to the petition submitted during the final days of the '584 process.
Interesting....and hopeful....C'mon USPTO, put an end to this mularkey and issue that Notice!
