It is my understanding that because of the backlog of appeals, Germany decided to change the patent appeal to one of law only, so that new information can no longer be brought in. I believe DT probably got their appeal in before this change went into effect, but obviously the appeals court will now be less willing to look at new information even if DT is legally allowed to do it. Perhaps someone with more knowledge of the subject could post and provide additional facts and clarification. TIA
