Yes, I believe they were given 30 days to respond. I suspect they will try to reword it and make an attempt at differentiating. If for no other reason, to futher delay things. But IMHO the wording used by the examiner in the rejection might help speed up litigation settlements. It certainly does not hurt us in that respect.
