Here is some downside to filing in Germany. Refer page 4 to see how Germany determines what an infringer should pay for past infringement. There is no penalty for the past infringement. Patent owner just gets what he would have gotten if there was a normal commercial license in place during that time. It doesn't sound like a very big stick to me.
