The basis for the new reexam is the prior art mentioned in the intial request for reexam. How will you know whether that file is still the same as it was when it was first posted? If I was told that standard procedure is for the patent owner/attorney to download every file as soon as it is available and if I was told that that the owner/patent attorney is aware of the disappearance of the file, and told me that when the file is again available to the public it will be closely checked against the original copy - then I would not be so uneasy.
