Many here, including me, are thinking about the sale of the MMP. I'm wondering who it is that might be interested? Hard to see why there would be interest. Then I recalled someone saying that the MMP was a litigators dream, or something to that effect. Whether I have the statement correct or not, I think everyone would agree that it seems to be headed in the direction of the courts. Whether it has to go that far is not the point. For planning purposes, I think it must be assumed that every patent or application in the hands of the USPTO may have to be litigated in court. If you look at the basis for some of these rejections, that eventuality seems quite likely.
Sooooooo. IMHO the interested party is a law firm that is flush with $ and willing to work on this for a percentage of future MMP license revenue and some up front cash. When negotiations are done my guess is that Alliacense will still license, the new law firm handles all litigation, and a new or revised commercialization agreement is enacted, with PDS making a 3 way split.
If you couple the need to monetize the MMP in the short term with the increased potential for litigation here and in Germany, the above seems like the logical outcome, IMHO. Hoping we get a fair deal. GLTA Opty
