Here's the part that makes me cynical to the authenticity of the reported conversation:
"They are still evluating the 366 decision and may appeal."
MAY APPEAL!!!????
TPL should have had an "Appeals Plan" ready and waiting. If the final rejection really does look like Swiss Cheese as some have stated, there should be no contemplating on an appeal. I'm obviously no genius, but I stated in a post (prior to the issued rejection) that the tone of the USPTO towards the MMPs was not good and I could see where it was all heading. TPL should have been expecting this rejection. For all we know, TPL probably was expecting it and was already working on an appeal before the rejection was issued. The later statement is most likely correct IMO.
