Just checked the USPTO and was surprised that TPl/PTSC has started this with the 584 patent.

We don't know what claims were rejected with the 336, yet. Furthermore the 336 isn't invalied and we cannot estimate what influence a claim rejection has at all to the patent. So, I think TPL and PTSC will decide after a discussion how to proceed.
