"What DT business would be infringing on the MMP and why would it be? At first I assumed DT's involvement has something to do with their Mobile phone bisiness, but now I'm not sure. If they only sell the phones, is that infringement?

There is much more!

Deutsche Telekom is offering a wide range of products for the communications & networking/infrastructure business (most are produced by Siemens, Bosch etc.), you may look at T-Systems, a subsidary of DT:

"With a global infrastructure of computer centers and networks, T-Systems operates information and communications technology (ICT) for multinational corporations and public institutions. On this basis, Deutsche Telekom’s corporate-customer unit offers integrated solutions for the connected future of business and society. Some 46,000 employees combine industry expertise and ICT innovations to add noticeable value to their customers’ core business all over the world. T-Systems generated revenue of around EUR 11 billion in the 2008 financial year."

What's puzzling me, is why don't we see any actions in Germany? Our law is much clearer and stronger in favour of the patent holder...

So I can only see three reasons for the lack of new licensees:

1. They are currently negotiating with german companies (or those, who want to continue selling their products to Germany), but the companies are still refusing to pay the higher license fees.

2. They have finalized some negotiations and sold licences (and are continueing to negotiate with others), but don't want to publish it as long as the USPTO re-exams are pending. Could it be, they don't want to give the guys from the USPTO the impression a positive re-exam could bring huge money, something which would support all those, who see TPL/PTSC as "patent trolls"?

Maybe this is the main reason, why they stopped touting the horn for the MMP in the last year? Maybe the tactics are to say nothing about the financial possibilities of the MMP in order to play down the importance of the patents - in order to "take the pressure" of the examiner? Maybe just rose coloured glasses by me...;-))?

3. The third reason is one I don't like: The german decision is not strong enough to bring those infringers to the table - they are all awaiting for the USPTO...

I really hope, we get to know more - not in years or quarters, but in months and weeks: good night!
