Well, in this case, I think Moore and the legal reps must be hard-nosed. They should not have to negotiate anything and should not have to ammend the 148 because of Kajigaya. To do so would be giving the USPTO a green light to use improper prior art here and elsewhere. I would hope our position is fixed, and our legal rep made it clear we would appeal a rejection based on Kajigaya. If so, having Moore there would not add anything.
