The examiner would have us believe that Kajigaya's internal control signals are predefined sequence of instructions because they are formed in predetermined combination by selectively bonding mode setting pads........

I find two problems with this argument.

1. It is a mechanical workaround, and Moore was told that some of his arguments do not hold water because he was arguing means instead of method. (The mainframe vs microprocessor). But how can the examiner turn around and use means in his argument?

2. In the abstract as well as in the body of the patent discription it says <The processing unit is designed to operate in accordance with a predefined sequence of program instructions stored within an instruction register.> While stored within an instruction register was not included in the claim language, I think there is sufficient evidence that Moore is talking a program that requires electronic storage. A far cry from 4 or 5 control signals which are not electronically stored.
