IMO Rick said plenty about the German success. Even though it was all he could say. As you will note below in many of his other shareholder letters he has reminded us of how little he can say and what a difficult and complicated process it is to solve the re-examination issues. Today he simply stated that "he is pleased" and "we have completed", in Germany, something that is comparable to the lengthy, difficult and complex process we still have in front of us with the USTPO. As everyone knows, I'm sure Rick would also "be pleased" with similar results from the USTPO.

I’m also pleased to note that we recently announced that the German Patent Office has rejected a claim to nullify the German counterpart of an MMP patent. This nullity proceeding is comparable to the patent re-examination process here in the United States.

1)Update on USPTO actions on MMP patent re-examinations

I have stressed the fact that the patent re-examination process is a very complicated and lengthy process. Patent Office actions are publicly disclosed, and we look forward to the final actions by the USPTO. Both Patriot Scientific and TPL are involved in litigation regarding the patents, and comments regarding the status of the various patent re-examinations and patent office actions cannot be made at this time.

Patent re-examinations for 148, 336, 584 and 749 Late last year the USPTO began the patent re-examination process for four key patents in the MMP portfolio. This is a time-consuming, detailed process that can take months, even years. The company cannot forecast the progress nor the eventual outcome. The review process is a lengthy one as each patent has different issues to consider. However, the prevailing conventional wisdom, supported by statistical data such as the recent study by Pat Choate, noted economist and student of the patent system, is that the vast majority of re-examination proceedings result in the strengthening of the patent being re-examined.
