Although at times I look at the negatives just to be unbias, and as accurate as possible, I also like to speculate and dwell on the posotives about PTSC. I think we can agree that we have problems with the 584 patent, which along with the 336 and 148, was one of the three main patents in our portfolio. It apprears that Judge Ward's claim construction was, so far, right on the money concerning the 584. He was upheld against our appeal, and apparently the USPTO agreed with him on his determinations. Now with that being said, to put a positive slant on that statement, we should all be feeling pretty good about the chances of a positive re-exam on the 336, and 148. The Judge has a phenomenal record with his decisions being up-held. Taking that record into consideration it is no wonder that Asustek decided to settle. TPL, in doing so, greatly enhanced our chances of returning to that venue, which could mean a kiss of death to the T2. Personally, I hope that this time around we follow thru to trial and do not let them off the hook, but instead make an expensive example of them.
