Just an observation and I am not knowledgeable enough to come to any conclusion but after the Litigation Search conducted for the 148 and the 336 a Non-Final Action was mailed....for the 584 a Final Rejection was mailed.

I can only guess that what happened in court has a lot to do with the USPTO's decision and perhaps what transpired in court for the 148/336 is in our favour or at least it made them think twice before rejecting.
