Message: New Pacer--(ORDER) The Court sua sponte TRANSFERS (Signed By Judge Folsom)

Perhaps I am just misreading this, but this is *appears to me* to be a transfer from Judge Folsom IN THE EASTERN DISTRICT OF TEXAS to Judge Ward IN THE SAME DISTRICT. In other words, that case we filed in Texas after the T3 sued us in California was (presumably by random lottery) assigned to Judge Folsom. Since Judge Folsom doesn't have any prior experience with any of these patents, and Judge Ward does, the two of them probably talked and Judge Folsom got some case from Judge Ward's docket and, in return, passed this one off to Judge Ward. I do not make much of the "first filed" language or the "pending" langauge other than that it is a very fancy way of Judge Folsom saying "I have no idea what is going on here, but Judge Ward has at least some idea, so I'm sending this to him." This does NOT *at least to me* appear to be a transfer FROM CALIFORNIA TO TEXAS. What *should* happen next (if I understood the denial of our motion to transfer in the California court) is that there will be some hearing in front of Judge Ward and Judge Ward will transfer the case back to California since, as between the cases involving the T3 (not J3), the California one is first-filed and the California judge has already indicated that he is not transfering to Texas and is, instead, retaining control of the case. Corrections welcome. All IMHO.
