IMO it's highly unlikely that the USPTO knows about or cares about license sales. They are not judging a popularity contest.
But the sales this SEP-NOV Q have been to large companies and that says a lot about what the lawyers for these companies think about the validity of the MMP.
The chart below shows: Draught (since last sale), Announcement Date, Company, and Annual Sales $.
We had a 42 day draught going from last Q into this Q before we had the first sale. The next sale (Respironics) was 18 days later. That's an awfully slow rate of sales, and it seems contrary to the fact that large companies continue to put money on the table - a clear DD vote that the MMP is valid.
But my estimates say we should be closing sales at 2 per week -TPL seems to have the capacity. So what's the hold up? I don't have a clue.
