Opty...what had me confused more the the struggle you and the examiner had with"independent: and "synchronous" ...was the struggle I was having when I first read the examainers interview summary...and its worth a second look...
In the summary on 8/13 the examiner "suggested: how to handle the controversy over the "independent" wording and it's meaning...it was rebuked by Moore...
Now when one reads the latest posting today.."Applicant remarks" not only do we use his suggestion and add claims 11-20 just to further our cause with the "independent" terminology in the claims...our lawyers actually thank the examiner for his "suggestion".
This was the hurdle I was worried about...not the explaining of the terminology but the fact that we "took a second look" at the examioners suggestion and followed through on it....WISE, WISE MOVE on our lawyers part.
That should end a lot of the contention that I read into the examiners summary and should help get 336 through this process and an "Intent to issue a Reexam Certificate" posted a lot sooner than I was expecting.
He is really there to help the patent holder, when they make "suggestions"...use them...good move on our part...IMO
