As i understand it,the process of infringement starts with the notification by the patent owner to the potential infringer...as long as they have been notifed that is the date of record...even if the patent expires by the time it comes to fruition. It is the patent owner's onus to notify the potential infringer not the infringer to seek out the patent owner.
