"If we worded the contract with Intel and other chip manufactures to clearly state that their customers are liable for a license fee does the Supreme Court ruling affects us?"
A contract stipulation cannot overcome the law of the land. So, yes, it effects us, in that, IMO, this ruling may render our contracts/licenses with chip manufacturers "void", as the intent cannot be satisfied.
To all those who think the early signers (Intel, AMD, HP, SONY, etc.) got a super deal, we now (IMO) may have another shot at them.
Thinking positively, it's a "just think, with all the ammo we didn't have then, but do have now, what deals we could make?".
There may be a silver lining to all this.... This is/was probably the only way we could get another shot at those guys.
I'm thinking TPL is experiencing an "attitude adjustment" with regard to the benefits of ongoing royalties.
