Here's the answer I received today from the Company via Ken:

To our knowledge, material non-public information has not been selectively disclosed by the company.
The financial outcome from the settlement was broadly disclosed in Mr. Goerner's letter to shareholders of April 10th, which was also voluntarily filed on Form 8-K shortly thereafter. Disclosure regarding the financial outcome of the settlement was as follows:
".. our April 9, 2008 earnings release, which fully reflects the financial results of all transactions announced prior to the end of January 2008.."
This has been reiterated to anyone who has inquired subsequent to its original release, as we are doing now for you. No other details have been disclosed to any party. If there is specific material information that you believe has been selectively disclosed please bring it to our attention and we will address the matter."
