Do you honestly think that Rick Goerner is that stupid? That he would determine the value of this company on past and present market cap and sell, when the patents are so close to being revalidated and will increase in power for the remaining hundreds of infringers? It dosn't make much sence to me and it surely is nothing I'm going to lose sleep over right now. Besides if we stay public after a merger I'm not convinced it's a bad thing.
