Interesting wording. See 90/008237 IFW 4/11/08 entry Page #8 under Conclusions #2. The reexamination files are being forwarded to the examiner for issuing a first office action.

If the exam is only starting, then perhaps determination of first office action would be more correct. Almost sounds like reexam is done. Perhaps means nothing, but interesting none the less. Opty
