Yup, their responses are very confusing to me, too. It echos the "Record Room" weirdness. They're either in re-exam, or they're not (i.e., they're done). If they are in re-exam, the patent files would be in the examiner's office. The only "out" is if adequate electronic records exist (paper files not needed). But, per the USPTO Glossary, "IFW" means:
"IFW: Image File Wrapper -- an electronic version of a patent application, including image and/or text versions of the bibliographic information, all papers as filed, and all office actions and correspondence related to that application."
She told you that the '336 is NOT IFW. No electronic version, paper only. In storage? Placed there recently? Per the guidance I found at USPTO, this shouldn't happen unless the re-exam is "concluded". Yet no word of a cert. Time lag in posting the status update?
This is nuts. And, BTW, this is where EVERYONE's focus SHOULD be. Not on some (intentional IMO) distraction that does us no good.
While I agree with most if not all criticism of the BoD, I have a rough time blaming them in total (but partially) for PPS performance over the last two years. Ya see, we had this guy named Swartz selling, massively, and we had this litigation thing (that probably isn't fully represented yet), the necessary silence, and this question as to the validity of the patents (re-exams). Reality. Seemingly overlooked by some.
Further, I for one don't plan to be invested here for the next 5-10 years. I doubt that many here do expect to hang out here that long, or even beyond another year, regardless of what happens, good/great, or bad. Thus, I don't even care about some ineffectual initiative to alter the BoD which, even if successful, wouldn't be fully effective for at least a year (even if certain members were removed, they'd have to be replaced with ??? - the people initiating the action?). And what is the immediate result of the initiative? To make PTSC look like a great investment?
And don't get me started on the TPL takeover thing. Not until someone can tell me specifically how the management of PTSC would benefit - beyond their probably benefit in maintaining the status quo.
This obviously is not directed at you, Bill. More to people who probably have me on ignore.
