The court would only retain jurisdiction to enforce the terms of the MOU because the event/agreement was not complete at that time and the court was required to assure the parties complied with the MOU when in the future either time or event required the courts stamp of approval that all terms have now been met.

Why else would the court be required to enforce anything if all terms and conditions were known and met at the time of the order of Dismissal?
