In the beginning I believe the first mover discounts were to provide quick uncontested license fees to create a bankroll to go after the big fish such as J3. Any fight or litigation would not have been possible given the limited TPL bankroll.

That is why I cannot believe TPL spent years and millions of dollars for a small settlement.

There has to be more to come and the USPTO acting as jury may be the course TPL took.

The NDA was to keep prospective licensees in the dark.

Why no new licensees recently? Maybe they are all betting on the USPTO and refusing to sign licensees except for small amounts which TPL also says lets get what we can just in case.
