Why keep it a secret? Because you never say up front what you're willing to do in negotiations - you (in this circumstance) go in demanding big money now. Then you sit down at the table, let them tell how they are hesitant because of the re-exams, and then tell them that we'd be willing to license to them for X times the amount on a contingency basis. This course especially if they refuse to do anything due to the re-exams. Lock 'em down.
How does it look to others that have settled? They're probably rubbing their hands together and saying "oooh, our competition is going to be paying through the nose".
Those with Notices? Just another piece in their negotiating bag of tricks (like it wasn't there already). It still all comes down to pay me now or pay me a lot more later.
The media? They're already calling us trolls. What are they gonna do, call us "patient, confident, greedy trolls"? LOL That would be an improvement!
