  • FY 05 - $3.05M in license revenue
  • FY 06 - $80M in license revenue (PTSC share slightly less than half)
  • FY 07 - $110.87M in license revenue (PTSC share slightly less than half)
  • FY 08 - $113.49 ESTIMATED in license revenue with an almost one entire quarter still remaining (PTSC share to be about 5-8% less than half estimated)

Regardless of the USPTO status, the MMP is making PTSC some serious money and it's been consistently increasing. Considering the USPTO re-exam process may take another 12 months to resolve, there is no reason the money won't continue to come in. Afterall, even those who have tried to legally challenge the validity of the infringement claims have had to pay up presumably since they settled. If the April numbers confirm this (with numbers showing PDS license fees for Q3 north of $80M) then there is no reason for the market to continue to neglect the value that the MMP has consistently been bringing in.

Unless the 10q reveals some kind of "business resolution" tied to the USPTO decision, the USPTO really shouldn't have that much bearing on the current market valuation of PTSC as PTSC has been able to, and considering all the appeals that are available to PTSC/TPL with the re-exam, it should continue to collect cash for at least another year. Furthermore, it's got the money in hand from these last 3 years, and doesn't have to give it back regardless of the USPTO action (can't confirm this myself, but I sure gotta believe that Leckrone wouldn't be that foolish to sign deals contingent on USPTO validation).

Therefore, I think that the next 10Q, if it shows PDS revenue north of $80M, will be well received by the market. If it shows less, and is ambiguous about whether that's due deferred ongoing payments/royalties, then I think we better be prepared for more disappointment. If it shows less and confirms that there are no ongoing payments/royalties, then TPL/PTSC's claims of increasing fees is BS and I'd have to consider bailing. If it shows more than $80M, especially if it's upwards of $100M to $125M to PDS (PTSC would get half after expenses), then I think we can expect some excellent price appreciation, IMO.
