Negotiate is way to try and get a so called win-win for both sides. Both parties have to walk away from the deal thinking they got a fair deal.

There will always be negotiation regardless of any court decisions unless in the court a damage amount was declared in favor of TPL/PTSC.

PTSC/TPL are probably willing to negotiate alittle because as each company signs on... it continues to give them validation, strength and exposure to the "market". Any by market i mean the customers that need to pay for the MMP license (not stock market).

TPL/PTSC does care.... they want to maximize the license revenue. Again SP is not the first concern right now.... MAXIMIZING their license revenues is first. 41 Licenses already... wow... the pace is picking up. The SP will adjust and increase with more information, more licenses, and the strength & increased in license amount/revenue.

PTSC is not losing sleep over a few weeks that the SP is down...why? Because shareholders dont have the information... PTSC does.. if the settlement was big...the SP will take care of itself. If the settlement was low....then PTSC will lose creditibility and investors and the SP will fall.

EG. If IBM knows that APPLE paid $20 million for the MMP license... they have base from which to judge or estimate what they would be willing to be pay. If they dont know and PTSC/TPL comes in and says.... hey pay us $50 million...they start negotiating from there..... shoot.... PTSC/TPL could probably tell IBM that APPLE paid $75 million and that IBM Is getting a nice deal at $50 million if they pay now..... etc. Bottom line is that IBM doesnt know..... and that gives the strength and leverage to PTSC/TPL.... information is key to making decisions... when you have incomplete information... your going in blind...
