I would say the "threat of a full trial, treble damages and injuctions" have been, or would be, seriously damaged, but certainly reduced, for PTSC... not neccesarily GONE.

There is still I believe an avenue for treble damages in this Bill, but proving such appears to be more difficult.. corrections welcomed

Threat of injunction had been reduced prev by the eBay ruling I believe.. this certainly wouldn't help

Regardless.. This Bill IMO would result in the overall weakening of the MMP's value... Our hammer over infringers' heads would not be as large.

If passed, I am hopeful that, as Ease has posted, Pres Bush would veto... then we would see if Congress could override. An elected Democratic ticket would probably not be good for our side on Patent Reform... Perhaps Sec 5 would/will undergo a rewrite to be less 'reforming'.. Then there is the issue of venue.
