01/30/08 Senator Dianne Feinstein
United States Senate
331
Hart Senate Office Building
Washington, D.C. 20510   Dear Senator Fienstein I am writing to express my concern over the current Patent “Reform” Legislation in Congress.  If passed, Senate Bill S. 1145 will have a serious impact on the economic prosperity of the USA. Americans have a unique gift of creative thought, and this talent has helped make our Country one of the most economically and technically advanced in the world. While outsourcing of labor has plagued the nation, the current patent system has protected the power of invention and helped maintain our current standard of living.  As our nation begins to slip into economic uncertainty, the stability of our economy will surely be gone if we cede the power to protect our creativity through patents. The proposed Patent Legislation does just that, in an attempt to reduce so-called perceived abuse, this bill takes the drastic step of reducing patent protection.  This bill also completely fails to take into consideration the major changes implemented by the Supreme Court over the last eighteen months, the impact of which much less the “intended” consequences are not yet understood.  There are changes that need to be made, but destroying the protection of an effective patent system will accomplish nothing but make it harder for the American inventor and entrepreneur to protect their ideas and attract the financing necessary to create jobs.  While I oppose this bill in its current form, I do recognize and urge the need for true Patent Reform. The most effective path to reach true reform is for Congress to support the operation of the existing system by approving the adequate funding necessary for the effective operation of the USPTO.  As a Senator from a state that has little to gain but much to lose from this legislation, it is essential that you show support for stronger patent laws, and opposition for the current bill which does nothing but weaken the patents and add more bureaucracy to an already bloated system.  This legislation has already been rushed through the House, and we therefore appreciate your urgent attention to this issue.    Sincerely

 Concerned Citizen
