I can almost agree with you except for a few loose ends. Primary being B&O cut their own throat by doing so because now they don`t get paid. I guess backroom deals are possible (I think Intel is familiar with this concept)but risky.

In addition, I would think all work product from Higgins will be inadmissable. Therefore, how do you use any of the Higgins info, even if it leads you to the truth?

If you`re right, I sure hope they wracked their brains looking for other alternatives before deciding on this one.
