If I remember correctly, the patents have been challenged in the past and a re-examination requested. I think re-examination was requested by more than one entity. The discontinuation of the examination may be because re-examination can only be requested once. If one of the 350 companies on notice request a re-examination directly they open themselves up for treble damages for having knowledge of infringement. Or at least that’s how I understand it.
