I think the patents are valid, but if I was infringing upon them I certainly wouldn't admitt to it when I could get the Technology for free and make billions in the process. After all they were invented by two entrepreneurs who didn't have the money or resources to defend them, that is,until the evil patent trolls came along and spoiled everything.
