While what you suggest has merit, keep in mind that we KNOW that at least one of the Js had some $750M budgeted/authorized for legal expenses.  Also keep in mind that the term "business resolution" was used for all the defendants I believe, not just one.  It seems that it would be extremely difficult to achieve a business resolution as you suggest with ALL of the defendants (as opposed to just one) - the complexity would be overwhelming.
