It wasn't such a dumb question, really. One would think the NDA would be multilateral, affecting all parties. However, I suspect that it is the Js that pushed hard for the Confidentiality Clause (NDA), as I presume they are the ones that wish for nothing to be disclosed. In this case, a multilateral agreement would make sense because of the multiple defendants, assuming that one J may have gotten insight, however limiterd, into what another J agreed to. As far as an NDA to cover internal/"within a J" disclosure, I would think that such a thing would be unnecessary, as an NDA is essentially typically included as a condition of employment.
