Message: Proposed Patent Reform and the Market for Ideas

Though you didn't post this necesarily in the context of impact on PTSC, it is implied.

I'm open to correction, but per my last reading of the draft legislation, if approved, it will only impact patents granted as of one full year AFTER the legislation is approved. Thus, IMO, we skate.

Going a step further, as you know, this patent reform is "sponsored" (via lobbying the Dems in Congress over the last year, after 4 years of trying and getting nowhere with the Reps) by certain high tech firms in the electronics arena. The pharmies are violently opposed. Now, looking at te current administration, who has more clout, high tech or the pharmies? The obvious answer is "the pharmies".

Thus, IMHO, this legislation is going nowhere. If it were to get through the House and Senate, Bush would veto in favor of the pharmies, and the dems in the Senate don't have the votes to overturn.

IMO, this whole song and dance is as depicted in one of the related articles. The Dems are courting high tech for their money (election campaign funding - the primary focus of ALL Congresspeople), with no real intent or expectation of this legislation being successful.

Now think of this.... If this legislation had any chance, wouldn't you think we'd be hearing a little more about it in the press? And wouldn't you think that the pharmies, with all their available funding, would "advertise" a public outcry to assure its defeat? After all, it would be a pretty "easy sell" to the public, prompting pressure on the Congressional representation.

Sorry, but I'm just tired of reading of the "spectre of patent reform", especially with regard to PTSC. IMHO, it's "much ado about nothing". The ONLY thing, IMO, to take from all the "smokey hooplah", is that it all revolves around the slimey games played by politicians - in this case apparently the Dems - to get money to continue their "career".

I'm open to correction or debate....

'Cuz I KNOW nuttin'!
