I hear ya. But I'm responding to this in the context of Lecy saying our team doesn't want to deal with any of the associated accounting/quantifying issues (or, IMO, the risk). The alternative I suggest avoids any significant accounting issues to which Lecy is opposed.

Hopefully this discussion will be rendered moot with lump sum payments from the Js.

As this goes on, the bigger the dollars involved I suspect.

As for our being questioned re: our shared opinion re: the current request for Stay, and our conclusion that the 17th is the day, I strongly suspect that JW did not rule, but advised the litigants that he will sit on the motion for a week (till COB the 17th).

I further suspect that, sans a settlement, JW may impose sanctions on the Js (not unfamiliar for Toshiba). Certainly that threat also hangs.

My only fear at this point is that JW may be getting pissed at our team - it takes two to make a deal. But, we have IMO appeared to be the "cooperative" side throughtout this process - certainly more so than the Js IMO.
