You asked how may a stay be granted without a response from the other side?

I don't know whether it can or can't I am not an attorney. So are you saying that JW can't respond until he receives a motion (for or against) from TPL/PTSC? If that is so, then perhaps TPL/PTSC have not filed their motion because everyone believes this is close and by stalling, it will get done.
