USPTO 336 ACP Need Legal Help

Just looked at the 13 page IDS filed on 9/24.  Interesting to see so much related to the Fish deposition of 6/24-25/2007.  Looks to include exhibits that would be covered by ACP.  Communications between Fish and Higgins etc.  Question then is -  Can the USPTO use anything covered by ACP?  If they did, would we be able to appeal it?    TIA   Opty
