I have read the USPTO's examination notice of the 336 patent but know nothing about the 584 patent accept that it is in Federal Appeal Court regarding the Markman hearing view of claim 29. I think Albie got the Appeals Court Hearings mixed up with the USPTO ex-parte examination. He mentions testimony from various experts etc, which is not the way it is done in PTO reviews!!! |

If you research a little further, you might find that the USPTO is advised of ALL litigation concerning re-examined patents and as such will be aware of expert testimony, which may be used by the patentee in support of theit patent. You might also find USPTO use of Markman claim construction.
