Another thought on this subject. 

Past versus future. 

Any settlement achieved via the court/settlement of litigation will predominantly involve past infringement of the '148 and '336.

TPL has stated that what it has done as far as licensees to date is to basically foregive past infringement and license for current/future infringement.

These things in mind, the settlement should involve only past infringement of the '148 and '336; the follow-on licenses will probably be for future infringement/use of the entire MMP.

Two actions.  IMO, the settlement negotiations should be mostly directed at past infringement, and of only the '148 and '336.  When the other foot drops, it'll may be in the form of entire MMP licenses into the future.

This way of thinking has a way of making both of us correct!  LOL
