Who's in the driving seat? For individual patents within the portfolio to be licensed opens a very expensive can of worms. A company licenses one of the patents, another licenses 2, yet another licenses 3, etc., etc. Every 12 months all those companies will have to have their products examined to see if they are using patents outwith the license. It is for this reason that the Portfolio is licensed in its entirety.
That the current litigation is now focussed on 2 of the patents is irrelevant to licensing the MMP Portfolio. The Defendants are being sued for unlicensed use of the '148 and '336. Settling the infringement suit does NOT mean that they are exempt from further litigation for alleged unlicensed use. Settlement of the current claims DOES NOT AUTOMATICALLY BESTOW A LICENCE. It is 2 separate issues.
