As you say, then why didn't we get a quick office action like we did on the 584 following the overwhelmingly positive claim construction rulings?? I have stated here before that if an action was necessary you would have seen one by now. I believe the Markman rulings speak load and clear regarding the validity of the remaining patents therefore "no office action required"!!
