Also, IMO, influencing the eventual settlement dollars may be that TPL TTC do not want to take this all the way thru court as well.. and have the '336 determination wrt Obviousness.  If TPL were demanding say $250M / defendant.. I'd bet those defndnts might say 'OK, lets find out once and for all.  Let's see if a Tex jury can separate '336 from KSR when we are pounding them with KSR/Obviousness...'

I hope PTSC & TPL split $250+M, but my head tells me settlement will be a bit less than that
