Although im not 100% sure.... (would have been a great question for the SHM meeting)..... i seriously doubt PTSC/TPL would have a clause for that in the license.

I more willing to believe that in the contract or license for the MMP, there is a clause that the licensee can not sue TPL/PTSC should they lose a patent dispute in court.

The reason being that PTSC/TPL is giving the company an opportunity now to sign the MMP license for a considerably low cost. Also there no way PTSC/TPL would have distributed the revenues for the licenses if here was a possibility of it being returned. (Eg. Could sit in an account until the trial was over).

Just my thoughts though...
